In the following text we additionally inform you about the processing of personal data by us in the context of job applications. In addition you will receive information about your rights on the grounds of the EU General Data Protection Regulation (GDPR).In addition, you will receive information about your rights on the grounds of the EU General Data Protection Regulation (GDPR). This information applies to all candidates who submit applications to Deutsche WindGuard Company Group, meaning the following legal entities:  Deutsche WindGuard GmbH, Deutsche WindGuard Consulting GmbH, Deutsche WindGuard Offshore GmbH, Deutsche WindGuard Engineering GmbH, Deutsche WindGuard Wind Tunnel Services GmbH, Deutsche WindGuard Systems GmbH, Deutsche WindGuard Inspection GmbH, KEACON GmbH and WindGuard Certification GmbH. Which sections of this information apply to you may depend on which communication channel you choose to contact us.

Please note: The Data Protection Information exists in the English and German language. The English version shall merely be a non-binding translation of the German version. The German version shall prevail in case of any differences between the English and the German version.

Which data sources do we use?

We process personal data we received from job applicants.

Publicly available sources (e.g. internet, social media platforms) to collect information about you, but purely for the purposes of recruitment selection.

Personal data from other sources will only be collected or processed if you explicitly agree to it.

 

What else should you know about our recruiting campaigns on social media?

We support our recruiting activities by publishing adverts via our account https://www.instagram.com/deutsche_windguard/. The provider of this service is Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. The data transfer to the USA is based on the standard contractual clauses of the EU Commission. For details on how they handle your personal data, please refer to Instagram's privacy policy: https://privacycenter.instagram.com/policy/. The company is certified in accordance with the ‘EU-US Data Privacy Framework’ (DPF). The DPF is an agreement between the European Union and the USA, which is intended to ensure compliance with European data protection standards for data processing in the USA. Every company certified under the DPF undertakes to comply with these data protection standards. If you interact with the adverts of our recruiting campaigns on Instagram, you will be redirected to a landing page for applicant data collection. This landing page is operated on the ‘Perspective Software GmbH’ platform. Here you have the opportunity to obtain information about our company and vacancies and then submit your application data. This data is processed for the purpose of processing your application and for further communication in the application process.

Your personal data is processed on the following legal bases:

  • Consent pursuant to Art. 6 para. 1 lit. a GDPR: By submitting your data to us via the landing page, you consent to the processing of this data for the above-mentioned purposes.
  • Legitimate interest pursuant to Art. 6 para. 1 lit. f GDPR: In certain cases, we process personal data to protect our legitimate interests, insofar as this is necessary to optimise our application process.

The applicant data is forwarded to the following recipients:

  • The data provided by you will be forwarded to an individual applicant email address of our company.
  • The agency ‘veomeo - Alexander Drost’ also receives access to the data in order to ensure that the advertising campaign and the applicant landing page function technically flawlessly. In addition, veomeo has access to the data to support and optimise the application process.
  • The operator of the landing page ‘Perspective Software GmbH’ acts as a technical service provider and also receives
  • also has access to the data in the context of data processing. ‘Perspective Software GmbH’ processes this data in accordance with an order processing contract with the agency.

The data collected by us via the social media presence as part of the recruiting campaign will be deleted from our systems as soon as you ask us to delete it, revoke your consent to storage or the purpose for data storage no longer applies. Stored cookies remain on your end device until you delete them. Mandatory legal provisions - in particular retention periods - remain unaffected. We have no influence on the storage period of your data that is stored by the operators of social networks for their own purposes. Which data will be processed by us?

As part of the application process, we generally process the following data:

  • First name and last name
  • Contact details (address, phone number, email, etc.)
  • Application documents (e.g. credentials, testimonials, cover letter, CV)
  • Further information that you provide to us.
  • Job relevant information from publicly available sources (e.g. internet)

 

For what purposes do we process the data?

We process the aforementioned personal data in accordance to the necessary extent for the purpose of choosing and recruiting a suitable candidate for employment.  The legal provisions, especially the European General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG), are observed. 

The legal basis for the processing of data is:

Data processing for employment related purposes of § 26, art. 1 BDSG

Further legal basis are:

Initiation and performance of contracts, acc. to art. 6 para. 1 lit. b GDPR

The processing of data may be carried out for the initiation or performance of a contract (verbally or in writing), which you want to enter or have entered with us.

Legitimate interest pursued by the controller, acc. to art. 6 para. 1 lit. f GDPR

A legitimate interest is for example, if the data is processed  (to respond to and defend against legal claims in connection with the application procedure.

Data processing on the grounds of your consent, acc. to art. 6 para. 1 lit. a GDPR

We may not be able to make an offer of employment immediately. However, you can give us your consent to process and store your personal data for a longer period of time than defined below (see for how long will my data be stored?), so we can take your application into consideration for future employment opportunities.

If we enter into an employment contract with you, we are entitled (according to § 26 Art. 1 BDSG) and art. 6 para. 1 lit b GDPR to process the data obtained during the recruitment process and to fulfil our legal obligations with regard to the employment.

 

To whom will my data be transferred?

Within our company group those persons who require your personal data in order to conduct the application procedure.

A transfer of data is carried out in accordance with the legal provisions, especially the EU GDPR and the BDSG.

We use third party job portals on which you can file an application with us.

If you have given your consent, we will forward your application to different departments in our company group to consider your application for job openings other than the one you applied for.

 

Is my data transferred to a third country?

No, all data processing is carried out inside the Federal Republic of Germany, the EU and the EEA.

If you interact with recruitment adverts published via our Instagram account, please refer to the section ‘What else should you know about our social media recruitment campaigns?’ above about the transfer of data to the USA.

 

For how long will my data be stored?

Your data will be processed or stored by us for as long as is necessary for the decision on your application and the filling of an open position.

The application documents of unsuccessful applicants are generally deleted six months after notification of the decision to fill a vacancy. If a longer processing of data is necessary for the defence against possible claims, the data will only be deleted after the end of such a dispute.

The data will not be deleted if you have given us your consent to longer data storage with a view to a subsequent vacancy.

If an employment relationship is concluded between you and us, we will store the data already received for the duration of the employment relationship.

 

What are my (data protection) rights?

The data subject – that is the person whose data is processed – has the right to:

  • Access acc. to Art. 15 GDPR
  • Rectification of inaccurate data acc. to Art. 16 GDPR
  • Erasure acc. to Art. 17 GDPR
  • Restriction of Processing acc. to Art. 18 GDPR
  • Data Portability acc. to Art. 20 GDPR
  • Object acc. to Art. 21 GDPR
  • Withdrawal of consent acc. to Art. 7 GDPR
  • Lodge a complaint with a supervisory authority acc. to Art. 77 GDPR

If you have given us your consent to process your personal data over a longer timeframe, this processing is lawful on the basis of your consent. You can withdraw your consent at any time. The withdrawal will only affect any future data processing and cannot be applied to data processing that has already been carried out.

You can object to the processing of your data at any time. In this case, however we will not be able to process your application properly and consider your application for the open position.

You can object to the processing of data that is based on the legal provision of legitimate interest. After that,  further processing of data is no longer admissible, as far as no urgent reasons worthy of protection on the side of the controller are present or the processing is necessary for the enforcement of legal claims or for defenses in lawsuits.

What are my obligations?

You are in no way obligated to provide us with your personal data. However, we may not be able to process your application and make an employment offer to you due to the missing information.

 

Is automated individual decision-making used?

No, we do not use automated individual decision making.

 

Do you practice profiling?

No, we do not practice profiling.
